New York state’s Martin Act embodies New York state’s antifraud securities laws, which like the U.S. Securities Act of 1933 and U.S. Securities Exchange Act of 1934, prohibit brokers and dealers from deceiving or misleading the investing public about securities transactions and investment risks. The Martin Act also authorizes the New York Attorney General’s Office to protect investors by investigating the “fraudulent practices” of brokers and dealers and, if necessary, subpoenaing witnesses and prosecuting violators.
