I don't know which Company is involved, but if I had to bet, it is one of four:
CMKX, OSTK, NPCT, or EATC.
I am waiting for the source, a Western lawyer, to return my call on his story from yesterday.
Casavant's lawyer says he is no longer a target, a fact I can neither confirm nor deny. That puts Edwards (currently in Beijing), Williams (in South America?), and Walters on a kind of hot seat. CMKX has organized crime stamped all over it.
OSTK has the most powerful single CEO in this arena, and the scum here have to be afraid of him. Being tightly held, OSTK has the most leverage on its own trading report data.
NPCT has the pending appeal in front of the Nevada Supreme Court, and I am pretty sure they have the support of their State Securities Commissioner, and of NASAA. The SEC Amicus brief given to DTCC should be engraved in stone.
EATC has the CEO with the record for the best learning curve of the early plaintiffs, and better yet, he has actually managed to get in front of the SEC Commission. When he was there yesterday, he proved to everyone he was no chump.
I think it is a toss up who gets on first, first.

I think this is related to one or more of four stocks, CMKX, OSTK, NPCT, and EATC.
They are now calling yesterday's events a Meeting with the SEC, with several agencies questioning the Amicus brief entered for DTCC.
I just spoke to the source, and he got this from a anon. DOJ source that gave the AP/UPI link last night, but he left it on the board, and lost it. He is going to try to retrieve it this evening.
Clearly, something has happened to cause questions to be asked of the SEC about what has been going on in shorting.
If I can get the link, I expect it to be to an obscure article, carefully written.

All,
I have just received an unconfirmed report that a task force of 25 Federal Investigators and/or agencies(?) hit the SEC today on the shorting scandal.
The source went on to say that the raid was related to reported perjury in a short selling case, either in a pleading or on the stand in a case.
The source says the matter has made a number of late editions of some publications, as yet un-named.
We have heard these kinds of stories before, so we have to treat them very carefully. Any and all should reach out to try and confirm or deny this.
If it is true, it comes on the heels of the brilliant presentation by Rod Young today to the SEC Commission, the hit occurring just hours after he spoke.
We have all hoped for something for so long with so many disappointments, it is hard to believe someone finally got off their duff here.
I just hope we are not disappointed yet again. Maybe the very rumor itself will break the dam.
I will get further reports this evening I will put up.
We will know tomorrow almost certainly.

Bud, I hope you're right. I have to question the dismissal of possibility EATC resumes trading. Why did the SEC grant this meeting to begin with? We know the SEC already aknowledged manipulation when they prosecuted Bryn Mawr. THEN we had at least 3 Bryn Mawr characters enter guilty pleas. EATC had some new info yesterday. HOW can the SEC seize property (EATC stock) when they admit there was manipulation?

The SEC Commission had to take the meeting because of the issues raised by Young with the Federal Judge in his de-registration hearing. The Federal Judge in that proceeding saw sufficient merit and questions raised to order the referral.
They don't care that Eagletech and its shareholders were screwed, they only care about whether or not they made their filings, not why.
The situation is disgraceful. Rod expects them to rule against him, then take them to Federal Court on appeal, where he looks forward to deposing key parties on the matters he is concerned with.

the rats are already singing. On 9/2205 there was an EATC docket entry for subpoena of add'l docs. from 10-05 to 12- 05 there were 3 Bryn Mawr rats copping guilty pleas. Persico,Garbo, and Henricks. Read the SEC admin proceedings. They have LOTS of new evidence should they be denied this go round. Though it sure doesn't sound like the SEC addressed any of the judges questions in his referral notice.

I spoke to the source of my story today, a lawyer I had previously spoken to several times. He says "raid" might be too strong a word or not, or possibly a multi-jurisdictional meeting called with the SEC. I can see the latter more to be more likely. I don't know if subpoenas were involved.
He saw the press link last night on a board he goes on, and is going to try and get it from the site he was one. Like I said, if I get it, you get it. I hope it hasn't already been taken down.
Mark Faulk is writing a book on the CMKX story with support of the Owner's Group.

We have spoken many times, and communicated by Email more frequently yet. He is very professional, and he is doing a pro's job on the book, which he hopes to have out in June.
The FTD issue is getting real transaction, as is the issue of tax free income to shorts if they bankrupt a company.
The story is now around from other sources according to reports made to me from posters to boards, some posts made before I heard the story.
I don't post to or read boards, not unless I have a specific objective with regard to a specfic board, as I did with a board on Silicon Investor.
This latter information is courtesy of a party I introduced to a Federal Investigator on the CMKX matter, a man of absolutely untouchable integrity.[/b]
I am wondering if I would have been better off letting the whole thing come out from other sources, but I would note that my material is both widely read and disseminated, and no one with appropriate credentials has come forward to deny it. And those who should have denied it if it were not true surely haven't done so.
In the American system, silence is assent. Right makes Might. This story has a ring of truth to it because knowledgeable parties know the issues are in the faces of the American public, and it can't be kept quiet forever. No one is going to "control" or "Manage" this story.

I have other sources confirming the story, from completely different directions. Generally, Federal Agencies will neither confirm nor deny a story, but how they do this speaks volumes.
I have a very experienced player asking these questions third hand, right now.
For Smith and Star, there have been no denials of this story by any related party in the Government or SEC. You choose to interpret that as a story that will never come out?
The same thing was said about Pitt squelching the Forbes Story on Eagletech years ago. "No statement" is in US law considered to be assent.
The silence on this from those who could refute it outright is deafening. You assert that this silence is proof of there being no story. That is a crock, fallacious logic to its core.
I have a confirmation of the story from a very reliable lawyer souce I have worked with for over two years who reported this initially, but failed to save the link, obtained in one of his chat rooms. He has asked for the members of that room to get him the link. I have protected his identity as a courtesy, and will continue to do so. If he has been a victim of a false negative story, it would be the first time in my experience with him.
This source confirmed the original links of John Edwards, Rendell Williams, et al to and as the potential criminals in the CMKX case, and he has spoken with Wes Christian and the lead DOJ investigator on the CMKX case several times. [/b]
If you have a source of similar quality denying this story, put it up here with their name on it, not from an anonymous poster.
I put out information on the Elgindy terrorism links in 2002, and they weren't confirmed by hard information until late 2005, and again in the article on Judy Miller yesterday. Many of the assertions of facts in this space have taken years to confirm.
I will trust my own judgment on this one. If you want to check my record of predictions, go into my files here or on www.cfrn.net/investigates.
I feel that I have sufficient confirmation about this to be comfortable with what I posted, and to know its probability of being completely or nearly completely true. One fact out of a hundred being off doesn't disabuse a full assertion contained in the body of a complete story.
God hates cowards. I stand by the story as it was told to me because I trust the source from many prior contacts. Was he lied to? We'll see.
