RE: Evidentiary Hearing, Interpleader
To All CMKM/NHHI Shareholders:
Evidentiary Hearing
An emergency hearing was held on March 4, 2015 in Clark County District Court with regard to a large judgment obtained by CMKM and reconfirmed over two years ago. The evidentiary hearing had been set for March 12, 2015, but was pushed forward due to the defendant’s alleged travel plans and attempts to get the hearing delayed until May. Due to the mass of evidence, conflicting testimony and other legal wrangling, the judge has ordered another hearing for March 17, 2015 to further clarify certain issues before rendering a decision. A third hearing may be required, or the judge may rule on March 17 – there is no way to know until the judge is satisfied that a fair ruling can be made.

Interpleader
I have received renewed questions regarding the infamous “interpleader” issue from 2007, and will once again attempt to briefly clarify the matter with the hard facts. Former CMKM attorney J. T. Moran III was allegedly instructed in 2007 by former CMKM insider and CEO Urban Casavant to file an “interpleader” with the proper court with regard to the distribution of a large block of Entourage shares to CMKM shareholders. Court intervention would have been needed to distribute the Entourage shares due to the incomplete nature of CMKM’s recordkeeping and “official” but incomplete shareholder list. The idea of the “interpleader” was to get a court to authorize distribution of Entourage shares to an unofficial shareholder list assembled by the CMKM Task Force.
This issue is far too complex to be fully discussed in this brief update. However, the hard fact is that an “interpleader” was never filed by J. T. Moran III or anyone else. CMKM was ultimately sued by Entourage and settled the lawsuit by returning the 45,000,000 Entourage shares to Entourage as part of the settlement agreement.
Regardless of the rumors, beliefs or misinformation circulating among a few CMKM/NHHI shareholders on Proboards, chat rooms or whatever – an “interpleader” was never filed and the issue is completely dead, with no value to NHHI or its shareholders as we continue the difficult process of building a legitimate business from the ashes of what was a massive fraud called CMKM Diamonds, Inc.
